Terms and Conditions of the Sponsorship Program

§ 1. General Provisions

  1. The Organizer of the sponsorship program “Nova Heritage Grant: Forge the Future Initiative” (hereinafter referred to as the “Program”) is the company Nova Arnory – Michał Rutkowski with its registered office in Poznań, Jarochowskiego 36/5, zip code 60-238, VAT ID / Tax ID: 6662087428 Registration Number: 389371717 (hereinafter referred to as the “Organizer” and “Nova Fencing”).
  2. The objective of the Program is to globally support the development of niche and local Historical European Martial Arts (HEMA) and classical fencing clubs, promote the sport among youth and adults, and popularize the Nova Fencing brand.
  3. Support under the Program is provided in the form of a complimentary transfer of sports equipment – Nova Fencing training swords – for training and educational purposes (hereinafter referred to as the “Grant”).
  4. The Program is aimed exclusively at sports clubs, associations, foundations, and registered fencing schools (hereinafter referred to as “Participants” or “Clubs”). The Program is not open to private individuals.
  5. Submitting an application to the Program via the website form constitutes full and unconditional acceptance of these Terms and Conditions.

§ 2. Eligibility Criteria and Application Process

  1. To apply for the Grant, Clubs must meet all of the following criteria:
    • Conduct regular, documented training activities in fencing.
    • Demonstrate a clear need for training equipment to develop their local fencing community.
    • Maintain active and public profiles on social media channels (Facebook, Instagram, YouTube, or TikTok).
  2. The application process is conducted entirely electronically through the official application form available on the Organizer’s website.
  3. The decision to admit a Club to the Program, as well as the final scope of support, is made individually by the Organizer’s representative based on an analysis of the submitted application. The Organizer reserves the right to refuse the Grant to any applicant without providing a reason.

§ 3. Scope and Subject of Support (The Grant)

  1. The subject of the Grant consists of training swords manufactured by Nova Fencing, tailored to the specific profile of the selected Club’s activities.
  2. The limit of equipment provided to a single Club is 10 to 12 pieces of training swords, depending on the Organizer’s individual assessment of the Club’s needs.
  3. The final selection of models, specifications, and technical parameters of the provided swords is determined solely by the Organizer in consultation with the Club.
  4. The provided equipment becomes a permanent free lease of the Club, designated strictly for shared use by its members during official training sessions and demonstrations. Any resale of the equipment to third parties or individual Club members is strictly prohibited unless otherwise agreed upon by both parties in a separate written agreement.

§ 4. Logistics and Customs Procedures

  1. All shipping costs (air freight preferred) for the assigned equipment from the Organizer’s warehouse to the Club’s headquarters must be covered in full by the Participant (Club).
  2. The equipment is shipped as a non-commercial donation for educational and athletic development purposes. The Organizer will provide the Participant with an official Grant Agreement and a Certificate of Donation, confirming zero commercial value of the shipment for customs purposes.
  3. The Participant is solely responsible for completing all import and customs clearance formalities in the destination country. The Organizer is not liable for shipping delays, local taxes, or customs duties imposed by authorities in the destination country. However, the Organizer declares full support in providing the necessary documentation to facilitate customs clearance.

§ 5. Promotional Obligations of the Participant

In exchange for the equipment support, the Club agrees to actively promote the Nova Fencing brand for a period of 6 month from the date of receiving the equipment, under the following conditions:

  1. Status Disclosure: Displaying a permanent notice on the Club’s official website (if applicable) and social media channels reading: “Sponsored by Nova Fencing” or “Technical Partner: Nova Fencing”, including an active hyperlink to the Organizer’s official website.
  2. Social Media Activity:
    • Publishing at least 2 posts per month on Facebook/Instagram showcasing training sessions featuring the Nova Fencing swords, with the mandatory tag @nova_fencing_com and hashtags: #NovaFencing, #NovaHeritageGrant and #ForgeTheFuture.
    • Publishing at least 4 stories per month on Instagram/Facebook tagging the brand.
    • Creating and publishing one “Unboxing” or “First Impressions” video review within 14 days of receiving the package.
  3. Visual Media Rights: The Club grants the Organizer a royalty-free, worldwide right to use photos and videos submitted in reports or published on the Participant’s social media channels for the Organizer’s marketing and promotional purposes.

§ 6. Technical Workshops (Optional)

  1. The delivery of the equipment can be combined with a free fencing workshop led by a certified instructor and representative of Nova Fencing.
  2. The educational workshops (covering technique, proper equipment use, and maintenance) are completely free of charge for the Club.
  3. The organization of the workshops is contingent upon the Club covering the travel logistics and expenses of the instructor, which include: round-trip airfare/travel costs, accommodation, and meals during the visit. These details will be finalized in a separate agreement.

§ 7. Monitoring, Verification, and Sanctions

  1. The Club agrees to submit a quarterly photo or short video report to the Organizer, documenting the quantity, condition, and usage of the provided swords.
  2. The Organizer reserves the right to verify the condition of the equipment and the fulfillment of promotional obligations, including remote video inspections (e.g., a live video call) upon prior arrangement.
  3. In the event of a material breach of these Terms and Conditions, specifically:
    • attempting to resell the swords received under the Grant,
    • complete cessation of the promotional obligations specified in § 5,
    • using the equipment in an improper, dangerous, or highly negligent manner, the Organizer has the right to terminate the sponsorship agreement immediately and demand either the return of the provided equipment at the Club’s expense or payment of its full retail market value at the time of the demand.

§ 8. Final Provisions

  1. The Organizer reserves the right to amend these Terms and Conditions. Participants will be notified of any changes via email.
  2. Personal data of the Participants and persons representing the Clubs will be processed by the Organizer solely for the purpose of executing the Program, in accordance with applicable data protection laws (RODO).
  3. For matters not covered by these Terms and Conditions, Polish law shall apply. All disputes will be settled amicably, and in the event of failure to reach an agreement, by the court competent for the seat of the Organizer.
