TERMS AND CONDITIONS OF NOVA-FENCING.COM

§1. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:
Cookies – electronic data stored by a web browser on the User’s device.
Customer – a Buyer or Service Recipient.
Consumer – a natural person acting for purposes outside their trade, business, or profession.
Buyer – a natural person, legal entity, or organizational unit with legal capacity purchasing goods from the Seller.
Delivery – transfer of physical possession of goods to the Consumer or a third party indicated by the Consumer (other than the carrier).
Product/Goods – a movable item subject to a sales contract between the Buyer and the Seller.
Entrepreneur – a person or entity acting in the course of business or professional activity.
Terms and Conditions – this document governing sales and electronic services provided by the Seller.
Complaint – a claim regarding non-conformity of goods, including repair, replacement, price reduction, or contract termination.
Store – the online store operated at nova-fencing.com and associated social media channels enabling distance contracts.
Seller/Service Provider – Michał Rutkowski Nova Armory, based in Poznań, Poland.
Service – electronic service provided by the Service Provider.
User – any person accessing the Store.
Payment – funds received by the Seller under a sales contract.


§2. General Provisions

  1. The Store offers retail sale of products, including historical replicas and accessories, via distance communication.
  2. Minimum technical requirements: internet access, modern browser supporting HTML5/CSS3, JavaScript and cookies enabled, active email account.
  3. Customers may be Consumers or Entrepreneurs.
  4. Placing an order requires acceptance of these Terms; mandatory consumer rights remain unaffected.
  5. Prices are displayed in PLN or other currencies where applicable and include VAT unless stated otherwise.
  6. Users must not provide unlawful content.

§3. Orders and Payments

  1. Orders can be placed online 24/7 or via official communication channels.
  2. Available payment methods may include bank transfer, card payment, and electronic payment systems.
  3. The sales contract is concluded upon confirmation of the order by the Seller.
  4. The Buyer receives confirmation via email.
  5. The Buyer must provide accurate personal and delivery data.
  6. Payment deadlines may apply; failure to pay may result in order cancellation.
  7. The Seller informs the Buyer when the order is shipped and provides tracking details.

§4. Delivery

  1. Delivery is carried out via professional courier or postal services.
  2. Risk passes to the Consumer upon delivery.
  3. In case of transport damage, the Buyer should document the issue with the carrier.
  4. Shipping costs and options are presented at checkout.

§5. Right of Withdrawal (Consumers only)

  1. Consumers have the right to withdraw from a distance contract within 14 days without giving a reason.
  2. The withdrawal period expires 14 days after delivery.
  3. To exercise this right, the Consumer must inform the Seller via email.
  4. The Consumer must return the goods within 14 days to:

  5. Refunds are issued within 14 business days after the Seller receives the returned goods.
  6. Refunds are made using the original payment method unless agreed otherwise.
  7. The Consumer bears direct return shipping costs unless otherwise stated.

Exclusions:
The right of withdrawal does not apply to:
– customized or personalized products (including engravings, oxidation, modified handles, or design changes),
– goods made to individual specifications,
– other cases defined under applicable consumer law.


§6. Exchanges

  1. Exchanges may be possible within 14 business days if the product is unused and unchanged, and the corresponding product is available “on hand” at the Seller’s warehouse.
  2. The Buyer covers shipping costs unless the exchange results from Seller error.

§7. Complaints (Defective Goods)

  1. The Seller is liable for lack of conformity of goods under applicable consumer protection laws (including EU directives).
  2. Complaints may be submitted by email or in writing.
  3. The Seller responds within 14 business days. The procedure is described in the ‘Warranty and user Guideline” section of the Nova Fencing website.
  4. Goods should be returned to the Seller’s address with a description of the issue.

§8. Electronic Services Complaints
Complaints regarding electronic services are handled within 7 days.


§9. Dispute Resolution and Final Provisions

  1. Consumers may use out-of-court dispute resolution methods, including the EU ODR platform: https://ec.europa.eu/consumers/odr/
  2. Applicable law is Polish law, unless mandatory provisions of the Consumer’s country provide otherwise.
  3. For Consumers, jurisdiction follows applicable consumer protection rules.
  4. For Entrepreneurs, disputes are resolved by courts competent for the Seller’s registered office.
  5. These Terms do not limit statutory consumer rights.
  6. The Seller may amend these Terms with prior notice; changes do not affect existing orders.
  7. Promotions cannot be combined unless stated otherwise.
  8. These Terms are effective as of January 1, 2025.
